2) Eligibility & Acceptable Use

You must be of legal age to form a binding contract in your jurisdiction. You agree not to misuse the Services, including but not limited to fraud, unauthorized reselling, scraping, reverse engineering, interfering with security features, or infringing intellectual property.

3) Accounts & Security

4) Orders, Acceptance & Cancellations

Submitting an Order constitutes an offer to purchase. We may accept or decline any Order at our discretion (e.g., stock issues, suspected fraud). If we cancel after charging you, we will promptly issue a refund to the original payment method.

5) Pricing, Taxes & Errors

Prices, promotions, and availability may change without notice. You are responsible for applicable taxes and fees. We reserve the right to correct pricing or typographical errors and cancel Orders that arose from such errors.

6) Payment & Verification

Payments must be authorized and valid. To prevent fraud, we may use automated and manual verification, request additional information, or decline transactions at our discretion.

7) Product Information & Availability

We strive for accuracy in descriptions, images, and sizing charts; however, minor variations (e.g., color due to display settings) may occur. Availability is not guaranteed until Order acceptance.

8) Promotions, Coupons & Gift Cards

Promotions and coupon codes are subject to specific terms and may not be combined unless stated. Gift cards or store credits (if offered) are non-transferable, not redeemable for cash (except as required by law), and subject to expiry rules where applicable.

9) Shipping, Title & Risk of Loss

Shipping estimates appear in our Shipping Policy. Title and risk of loss pass upon delivery as reflected by the carrier’s records. Please verify addresses; we are not liable for delays resulting from incomplete or incorrect addresses.

10) Returns & Refunds

Our Return & Refund Policy forms part of these Terms. In summary: we accept returns of unused items within 30 days, provide prepaid labels, and fully cover transit damage or wrong items. See the dedicated policy for full details.

11) Intellectual Property & Limited License

All Site content (text, graphics, logos, photos, designs) is owned by or licensed to Fansmadedirect. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. Any unauthorized use is prohibited.

12) User Content & Reviews

If you submit reviews, photos, or other content (“UGC”), you grant Fansmadedirect a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such UGC for marketing and operational purposes. You warrant you own or control the rights to the UGC.

13) Copyright Complaints (DMCA)

If you believe content on the Site infringes your copyright, please email Email: [email protected] with: (a) your contact details; (b) a description of the work; (c) the URL of the allegedly infringing material; (d) a statement of good-faith belief; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data. By using the Services, you consent to such processing.

15) Third-Party Links & Tools

The Site may link to third-party websites or provide tools operated by others. We do not control and are not responsible for their content or practices. Use at your own risk.

16) Compliance, Export & Sanctions

You represent that you are not located in, under the control of, or a national/resident of any country or entity subject to sanctions. You will not use the Services in violation of applicable export or trade laws.

17) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor disputes, acts of government, or disruptions of transportation or communications.

18) Disclaimer & Limitation of Liability

AS IS: Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted, Fansmadedirect shall not be liable for indirect, incidental, special, or consequential damages.

19) Indemnification

You agree to indemnify and hold harmless Fansmadedirect from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.

20) Suspension & Termination

We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms or unlawful conduct. Sections intended to survive termination shall so survive.

21) Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Fansmadedirect is registered, without regard to conflict-of-laws principles. Courts in that jurisdiction shall have exclusive jurisdiction unless otherwise required by applicable consumer law.

22) Changes to the Terms

We may update these Terms from time to time. Changes are effective upon posting on the Site. Continued use after changes constitutes acceptance of the updated Terms.

23) Miscellaneous

• Severability: If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms, along with policies referenced (Shipping, Return & Refund, Privacy), constitute the entire agreement between you and us.
• No Waiver: Failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: You may not assign your rights or obligations without our prior written consent.
